These Terms govern your use of KwikPost, operated by Rafael Manuel Jr. (operating as an individual, doing business as KwikPost) ("KwikPost", "we", "us"), based in Doha, Qatar. By creating an account or using KwikPost, you agree to these Terms, including Section 5, which sets out the rules for using real people's likeness and voice — please read that section carefully.
You must be at least 18 years old to use KwikPost. By using the service, you confirm you're 18 or older and legally able to enter into these Terms.
KwikPost lets you generate and publish content across connected social media accounts, including: Quick Post captions, native graphic posts, AI-generated video (Video Generate, including reference/"Cast Yourself" mode), Talking Avatar videos, Product Swap and Character Swap video, and custom voice cloning. Features vary by plan tier, and we may add, change, or remove features over time.
You're responsible for keeping your login credentials secure and for all activity on your account. Tell us right away if you suspect unauthorized access.
Several KwikPost features — Cast Yourself, Talking Avatar, Character Swap, and voice cloning — work by turning a real photo or voice recording into AI-generated video or audio. This is the section that matters most for keeping that use lawful and respectful of real people, including you.
Every time you upload a photo of a face, a reference image of a person, or a voice recording to KwikPost, you confirm that:
You're responsible for being able to show that consent if we or a third party ever ask.
When you publish AI-generated content featuring a real person's likeness or voice to a connected platform, you're responsible for following that platform's own disclosure rules for AI-generated or synthetic content (many platforms now require a visible label). This sits alongside, not instead of, the consent requirement in 5.1.
We may review, remove, or restrict access to any content, and suspend or terminate any account, that we reasonably believe violates this section — without prior notice where the violation is serious (for example, content involving a minor, or non-consensual intimate imagery). Where required by law, we may report such content to the relevant authorities.
If you believe someone has used your photo, voice, or likeness on KwikPost without your consent, contact pixelspiritco@gmail.com with a description of the content and where it was published. We'll investigate and remove content that violates Section 5.1.
You keep ownership of the photos, voice recordings, and other material you upload. You grant KwikPost a license to use that material solely to generate and deliver the content you've asked for, and to operate the service (including sending it to the AI providers listed in our Privacy Policy). We don't use your uploads to train general-purpose AI models.
Subject to Section 5 and your compliance with these Terms, you own the content KwikPost generates for you. KwikPost and its licensors retain all rights in the KwikPost app, brand, and underlying technology. If you believe content on KwikPost infringes your copyright, contact pixelspiritco@gmail.com with the material's location and your ownership claim, and we'll investigate.
When you connect a social media account and publish through KwikPost, you remain responsible for complying with that platform's own terms of service and content policies (including AI-content disclosure rules). KwikPost is not responsible for actions a third-party platform takes on your connected account.
KwikPost is provided "as is." AI-generated content can be inaccurate, low-quality, or fail to generate as expected; we don't guarantee any particular output, that a platform will accept or approve your post, or that the service will be uninterrupted or error-free.
To the fullest extent permitted by law, KwikPost is not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim relating to KwikPost is limited to the amount you paid us in the 12 months before the claim arose.
You agree to indemnify and hold KwikPost harmless from any claim arising from your violation of these Terms — in particular, any claim brought by a person whose likeness or voice you used without their consent in violation of Section 5.
You can stop using KwikPost and delete your account at any time. We may suspend or terminate your account for violating these Terms, especially Section 5, with or without notice depending on severity.
These Terms are governed by the laws of Qatar. Any dispute will be resolved in the courts of Qatar, without regard to conflict-of-law rules. If mandatory consumer protection laws in your own country give you rights these Terms can't override, this section doesn't take those rights away.
We'll update the effective date above when these Terms change, and let you know in-app for significant changes, especially to Section 5 or Section 4.
